The virtual asset (VA) trading platforms listed below are licensed by the SFC under the Securities and Futures Ordinance (SFO) and regulated under the framework introduced in 2019 for centralised VA trading platforms in Hong Kong which offer trading of at least one security token. Members of the public should consult this list to determine whether they are dealing with an SFC-licensed VA trading platform.
A VA is a digital representation of value which may be in the form of digital tokens (such as cryptocurrencies, utility tokens or security or asset-backed tokens), any other virtual commodities, crypto assets or other assets of essentially the same nature, irrespective of whether they amount to “securities” or “futures contracts” as defined under the SFO.
Investors should be wary of the risks of trading VA on unlicensed platforms. If an unlicensed trading platform ceases operation, collapses or is hacked, investors may lose their entire investment held on the platform. Seeking recourse and legal remedies may be challenging. - Trading platforms which operate in Hong Kong and offer trading of at least one security token may apply to be licensed by the SFC for Type 1 (dealing in securities) and Type 7 (providing automated trading services) regulated activities. The licensing requirements are comparable to those which apply to licensed securities brokers and automated trading venues and additional requirements are incorporated to address specific risks associated with VA.
